Compromise is likely to survive challenges

A compromise effort supported by groups representing opposite sides of the vacation rental issue would signal to the public that this is a strong compromise effort. That would make a challenge via a citizens’ initiative, as happened in 2018 after a “just enforce the code” ordinance was passed, much less likely. The odds of a citizens’ initiative would be even smaller if Airbnb, which financed the 2018 initiative, supports the compromise, which it indicated is likely. Further, a compromise would reduce the chances of a legal challenge being successful, which was the case in Manhattan Beach when STR operators successfully sued claiming a “just enforce the code” ordinance there violated the California Coastal Act. Finally, the California Coastal Commission itself has indicated it supports Campbell’s efforts.
